It seems that our society, further our national culture, is unzipping at the seams that hold it together. Even great tragedies can no longer bring us together as one people. This seems the case at this moment, there have been other moments when the same came to mind to many before; there have been many “end of the world” times. Our predecessors made small changes that they felt would solve the problems, those very problems only rear their ugly heads again and again, decade after decade. It is in this vein I will put forth thoughts regarding many things, from the national constitution to the very birth of our children and the acceptable actions we take towards strangers on the street. Please understand I do not have any doctorates nor any well-known degrees, I am only a woman that fits into almost all categories in which a woman can fit along with being more interested in people’s actions and reactions. These are some things I have asked my elders, youth and professionals about. I must admit most of my information comes from my elders who are typically professionals and my own observations, from my life and my career as an official court reporter in civil and criminal courts, again discussed in depth with those aforeto mentioned persons. Take into account that these observations come from those people and myself. I would not say the reader will agree with these ideas, all I do ask is that the reader seriously ponder the ideas and the actions for which they are meant to cure.
The one thing that makes the United States of America singular in its origination and survival is the Constitution for which this country bases its government and its inner workings, its military actions and its laws. Over the years, our country has enabled many other countries, both big and small, to attain this democratic ideal. Sometimes our country made those changes possible by military actions taken upon those countries’ governments and sometimes by economic pressures. When war, through military means, has been waged by our country on the government of another, our populace should not ever consider the actions to be the fault of our military personnel. The military, from the highest ranking member to the lowliest, only follow orders of their superiors, meaning our President and our Congress. But when it is all boiled down to the largest of their superiors and therefore the bottom line, We the People are those superiors giving those orders. Our populace has avoided that basic understanding for many years, at least for the last century. I do not know what changed in that century where, We the People have turned our heads away from the actions taken by our government. Our national populace has taken up banners shifting the blame to this President or that party in Congress instead of knowingly understanding that the responsibility of our country’s actions is only ours, the national populace. Those military actions and yes, even the economic sanctions, are decisions that ultimately come from, We the People. Those actions and sanctions are no one else’s responsibility and ultimately are our greatest achievements or our worst mistakes. It does seem to bare out that the mistakes are not willingly accepted as each persons’ responsibility but that the populace distances themselves from that responsibility, blaming it on those elected officials we elected to lead the nation as a whole. I truly believe that somewhere after the Second World War is when the refusal or inability to accept national responsibility (each person’s responsibility equally) happened.
What was it that happened to our national identity that created such a distance from our government and its actions? Thinking on this particular query has been many years in the making because even as a teenager, I knew that something had changed our national mind about these things. I keep coming to one thing and one thing only, it was the children born nine to forty-eight months after that Second World War ended. Believe it or not, this is the generation that changed many of our national ideals and perceptions. Now before those persons born in that time period start bemoaning and frothing at the mouth, just calm down. Your generation only started that attitude and from there it has only continued to spiral out of control. It is not anyone’s fault in particular. It is how people were raised from that point after and from them to their children and so on and so forth. Before that war, America had only once before come out of Her own borders to assist other nations in their battle against other countries’ renegade leaders bent upon world domination. I think it is because the generation publically called “Baby boomers” were so many in number that the “I” became the way we perceived ourselves and not continued to be the “We”. Yes, I know we are truly a Republic and not a true Democracy which prizes the individual before a group but there is a fine line which the individual must accept that limitation. Think of it this way, after the baby boomers went to college for such formally prestigious careers like Law or Medicine, they could not find work or even make a living in those prestigious careers with those formally prestigious degrees. Those people who were mediocre and under that, sometimes even the very good ones, had to chase ambulances or specialize just to bring home food for their family’s table. It has gotten so bad in the field of law that our country is the most litigious country on the world stage and it does not look to get any better but worse. So in that same vein, did not those same baby boomers have to turn their backs on the “We” to concentrate on the “Me”? That very economical difficulty perpetuated itself in the generations to come by those parents who had to think of themselves and their families and not those of their neighbors because no one helped look out for them.
Yes, yes, at this moment in time we believe that it is wrong to live our lives in accordance of the “We” and instead look for personal happiness, therefore the “I”. Looking back upon the years of our national society from 1949 to this moment the collective “We” has willingly become the individual “Me”. From that point onward what great wonders have the “Me” contributed to our world or Her peoples? Before you go into a ramble of medical, technological or any of those kinds of wonders our country has founded, those very things were found for the “We”, the good of mankind. One can even go so far as to say that the philosophical, psychological and concentration more on the individual rights, thoughts or living for the “Me”, were brought about or thought about for the whole of mankind not just the greatness of one individual. I have others tell me it happened in the 1950s. During this time psychology was more of a social movement than a scientific one. I am not smearing the science of psychology, after law it is my favorite science. (Do not quibble with me about using the “science of” Law, it is a development of knowledge.) It was in the 1960s when psychology really got moving. The “Me” became the main, and in some cases, the only perception because psychology concentrated more on the individual. This probably happened without the conscious agreement of those individuals forwarding or leading this science. Hindsight is always 20/20 and I am certain that when looked back upon, those times or persons had no idea that the everyday, normal man or woman would take it to mean, “Screw you, it is all about Me”. Here, I will wander a bit to the side so as to help you understand that there is a balance in all things of life. There is a place for the “Me” but not before the “We”. We all have to live together, kind of like one big household. We all have to think and worry about what will happen to our neighbors, whether they live right next door or an ocean away. We all must take responsibility for our own actions and thoughts, much the same way as understanding that parents are not necessarily at fault for their child’s actions, a friend does not hold the same ideas as another of their peer group or a person is not the same as another of their siblings. Now onward and upward with these ideas….
So with all this in mind, our Constitution must be changed in such a way as to give back responsibility to the “We the People” when it comes to our government and its actions both within our country and abroad. I, personally, hate to have any amendment nailed to this document but it cannot stand as it does. If there is nothing mentioned here, it is not something I have left out deliberately.
So how to make these changes and to what? Here we go…. First, Legislative Branch. Much like the Senate there should be a static number of representatives applied to the House. I believe nine Representatives to each state would be a good and fitting number. Reasons for this are: We all know that our population, without a major national event, will continue to grow. This would give each state an equal say because no one state will have more influence over any particular legislation. It will also eliminate the cause for redistricting. Within individual state constitutions, this will be different by number of representatives within each state and should not be dictated by population but again by a static number for each district. This number should be up to the population at large to determine after some informed debate between its citizens therein. Reasons: This will enable all states to determine equally national legislation. It also makes constant redistricting unnecessary because the static number will not change.
The next ideas will affect both Senate and House of Representative members equally. All elected officials can only serve two consecutive terms and must wait another two terms beyond before being reelected to the same office. Reasons: This will keep the career politician a rare politician. It will also eradicate political puppets. Next: All elected congressional members shall be paid no more than $75,000.00 a year and cannot vote as a legislature to increase this. Any increase in congressional pay must be by national vote. Reason: This will make being a politician unappetizing to those who look for more than just service to their state and country. It will also keep each representative doing their districts bidding honest. Next: Representatives or their family members are not allowed in any form or fashion to take monies or gifts from special interests, be they large groups or one singular person. Reasons: This again will keep the people within the representative’s districts ensured that their representative is doing their bidding and keep them pure to that. It does not matter if the group or individual is from the representative’s district or state. There is no room for business of any sort in the legislative processes. Next: All representatives must vote in the way their district citizen’s desire as it is shown from electronic vote. (I will go further into this in a later chapter.) Reason: This will make each vote the actual will of the people. Next: Representatives from both houses will be eligible for free college tuition beyond a bachelor’s degree from their home state only for the members of their immediate family living with them. If a family member wishes to go out of state for a degree beyond a bachelor’s degree they cannot receive this benefit. Reason: The act of being a representative cannot be influenced by monetary recuperation and a college education should be available to all. Next: Any legislation that is to be applied to the national populace must be applied to ALL branches of government. Reason: Strict adherence to Amendment 28. Next: All representatives must be of high moral caliber. Now the definition of “high moral” character would be a person who does not lie, cheat or steal in any part or portion of their adult life. It is someone who does not have extra-marital affairs if married, tells lies about anyone or anything or fails to uphold the Constitution of the United States of America. If a representative is found not to have such character after they have assumed office they will be returned to their state as a regular citizen and never be allowed to attain these types of positions again. There will be an immediate vote within that district to replace that representative. Reason: This will keep only those persons who are true to themselves and their family group in the political arena. Next: All members of Congress, once they leave their seat, will no longer receive permanent congressional pay. Reason: There is no position known in the civilian world that one would continue to receive a normal paycheck after a person leaves their position.
The President of the United States and their immediate family are our nation’s face before the world, its enforcer of laws and its Commander-in-Chief. In the past, they were expected to essentially hold court wherever they went or whatever function they held for our country. The majority, if not all, Presidents have been lawyers and this seat of power has been kept away from the majority of the populace. Over the years we have seen extramarital affairs be conducted, secret meetings take place and even Presidential family members run about half naked. To correct some of these problems here are some ideas. Many of the requirements already laid forth in the Constitution should remain unaffected unless mentioned or you have another good reason to change it. First, if anyone is unwilling or unable to bring forth all finances, records or associations they are unable to become President. Reason: This keeps any unanswered questions about a person’s past to an absolute minimal and leaves little question for doubt that may follow any one person vying for this position of office. Next: No President can veto any legislation passed by Congress as a whole by 2/3rds vote. Reason: Presidents in the past threatened vetoes because legislation was unpopular to them personally. In this position, a person is not there to bring about their own agenda at all, period. It is a position the citizens of this country give out to be the face, enforcer and first general of our country and not the personal soapbox or the mouthpiece of the person seated there. Before anyone screams Congress will not do the will of the people, please be patient and follow along. You will see things concerning this position come together. Next: All powers not directly given to the position of President as stated within the Constitution as formal or informal, such as Executive Orders, are not allowed to change the law or make law for the nation at large. Reason: Within the powers of the President, they can direct military actions, usually after Congress as given him/her their approval that is within their power to do. A President cannot circumvent Congress to any degree for any reason. How the President runs his office and his staff is within his prevue but cannot use an Executive Order with which to make law. Executive Orders and the like are fine so long as those tools of the President do not make or seek to explain the law thereby circumventing Congress. Next: A person seeking the position of President must be of utmost high moral character. Reason: This will significantly reduce persons of marginal character looking to rule as a dictator or use the position to further their own social thoughts or desires. It also keeps any persons who have lied, stolen or cheated, while a regular citizen, from becoming the most powerful person in our country and furthering their desires. Next: Any legislation that is to be applied to the national populace must be applied to ALL branches of government. Reason: Strict adherence to Amendment 28. Next: The President will only be paid $250,000 per year. Reason: Most all of a President’s expenses are paid for while he is in office. This includes clothing for himself and his family, meals, transportation and etc. Finally: This is a position not for a political party but of a people. It is not nor is the person mantled with its power to look after their own ideals, social or otherwise. It is for them to lead their people in their people’s desires to be told to them directly, no one can stand between. This position is one that some persons in it have begged, borrowed, stolen and blackmailed others to further their own ideals, this will no longer be allowed.
The Supreme Court of the United States has been in charge of determining a law’s validity and meaning from the time of the beginning of our Nation. There are no duties or responsibilities that should change but the understanding of those duties and responsibilities should be refined. Supreme Court Justices of the past have dealt with death sentence cases as one of their many duties, which will no longer be their prevue. When a person is sentenced to death within a state, it will fall upon that state’s supreme court to make certain that the rule of law was followed. Reason: The Federal Supreme Court has a larger duty to settle disputes between individual states, the federal government and states and determining the meaning of federal laws passed. This is a very large duty and the death penalty of one person can no longer be made of the same magnitude as those duties. Next: All Supreme Court Justices will no longer be accepted by a vote of Congress and their term will no longer be that of life. Reasons: The Justices of the Supreme Court are positions of power and great responsibility and have too long been used by Presidents and parties to further their own views and desires beyond that of their terms. No members of Congress or the President can anymore further their own views or desires, only those of the people. It is because of this policy that the Justices can no longer be allowed to stand by a vote of Congress or for life terms. Next: A President suggest candidates from across the country for these positions and Congress can hold the vetting necessary, but it will be left to the people to vote and approve each justice placed. Reason: It is time that the people approve of all their leaders and the decisions they make. Next: The Supreme Court of the United States can determine the meaning of federal laws and determine the validity of individual state’s laws as according to the Constitutional validity only by how it was written but if further clarity is needed on the meaning of a law or statute, then the Supreme Court must send it back to Congress. Justices cannot try to forge social policy according to their own views or beliefs. Reason: Justices are in a position of great power and have tried and succeeded in determining social policy through their majority decisions. This is a country that values the individual under the collective “We the People”. No one person or majority belief in party or government can trump all the people of this nation.
Our federal government has become a whore to the agencies created by the Executive Branch to circumvent the Legislative Branch. Therefore, without any delay, all agencies not directly involved with military or health should be placed on deferment until such time as each and every one of them can be examined thoroughly for necessity. All committees and agencies overseen by the Executive Branch shall be absorbed by similar Congressional committees, allowing for one member appointment by the President. Any agency or committee that has any law enforcement involvement will be taken into by the Department of Justice. The Department of Justice leadership personnel will be appointed by the President but approved by the Congress and answerable to Congress, first and foremost, and will be disciplined by Congress. Any agency or committee that deals in any military issue will be overseen by the Department of Defense, except for any veteran’s issue which will be handled by the Department of Veteran’s Affairs. All agencies and committees dealing with any health issues will be handled by the Department of Health and Human Services. All minor agencies or committees will be similarly disbanded and absorbed into one of the main Departments within the federal government. All leadership positions within all agencies overseen by the Executive Branch will be appointed by the President, approved by Congress and held liable to Congress, first and foremost. All these departments are to serve the people of the United States and not one particular President. The idea of Executive Privilege will no longer be available to any Executive. If, for instance, a problem such as the Iran-Contra affair comes about, all employees or operators involved can be called before Congress and cannot withhold information under Executive Privilege. If anything is considered too militarily sensitive for world-wide consumption then private congressional meetings/hearings can be held but all transcripts will become public knowledge at the end of every Presidential term. If Congress feels that executive discipline is necessary then all information must be made public.
